Giudici milanesi, giudici europei. The derivatives scandal of Europe and the example of Milan.

E così abbiamo condannato qualche banchiere per una storia di derivati impropri venduti da banche al Comune di Milano. Il PM Robledo ha affermato che trattasi di un giudizio storico, essendo la prima volta che la mancanza di trasparenza da parte delle banche nel rapportarsi a entità governative viene considerato un crimine. In attesa dell’appello.

In attesa dell’appello apprendiamo da Bloomberg News che questi derivati sono con tutta probabilità andati contro le regole di gestione del debito perché in parte destinati a ottenere liquidità, così almeno disse un testimone al processo nel maggio di quest’anno.  Gli swap in questione non erano dunque fatti per immunizzare dal rischio d’interesse come invece dovevano essere.

Viene da chiedersi cosa succederebbe alla Goldman Sachs se si dimostrasse una qualche analogia di comportamento con i suoi swap con il Governo greco che tanto dolore hanno causato alla popolazione ellenica. Ma purtroppo non possiamo saperlo: la BCE è riuscita ad ottenere e proteggere la mancanza di trasparenza di tali operazioni riugiandosi dietro la gonnella dei giudici europei.

Ora abbiamo un motivo in più per dire alla BCE che è tempo che riveli i dettagli di quella transazione per eliminare definitivamente anche solo il benché minimo sospetto che essa possa coprire qualche operazione tra due controparti considerata, a Milano, criminale.

Now we know that swaps used by the city of Milan likely breached rules on how municipalities use derivatives to manage their debt, partly because they were used to raise funds, a judicially appointed witness said at the trial in May.The swaps were far from being hedges on the municipality’s interest-rate risk after being restructured multiple times, he said.

“It’s a historic judgment,” Robledo said. It’s the first time “that the lack of transparency by banks in dealing with government entities is a crime.”

Banks were were convicted by a Milan judge for their role in overseeing fraud by their bankers in the sale of derivatives to the city of Milan.

An appeal is likely to be pending. While we await for the appeal, please ask the ECB why it still purports to deny transparency to the Goldman Sachs vs. Greek government transaction in derivatives used for funding by the latter and that so much pain it generated on Greek families. The Italian sentencing leaves open the issue as to whether the ECB is not revealing a transaction between two counterparts that a judge in Milan would consider a criminal offense. It is in the best interest of the ECB to deny this fact by publishing the transaction once and for all.
